Premise

The publication of the products on our site constitutes an invitation addressed to the customer to formulate a purchase proposal and this proposal will have contractual value, once formulated it will lead to the complete knowledge and acceptance of the conditions present in the regulation set out below. The contract will be deemed concluded with Caminus accepting the proposal. The site offers products for sale both to users that can be defined as “final consumers” and to those with a VAT number.

The images of the multimedia catalog, accompanying the technical data sheet of the products, may not be perfectly representative of their characteristics, as the producers have the possibility to implement improvements to the product at any time without any prior notice.

The actual finishes of the variants indicated in the product data sheets may differ slightly in shade due to the video settings used by the customer.

  1. Acceptance of sales conditions and general terms

The contract stipulated between Caminus and the Customer must be considered concluded with the acceptance of the order by Caminus. By placing an order online, the Customer declares to have read and fully accepted the general conditions of sale and payment transcribed below.

The customer must keep these general conditions of sale (in compliance with the provisions of art. 50 and subsequent articles of the Legislative Decree 206/05) by printing a copy or saving it electronically.

  1. Purchase procedure

The customer can buy the products sold in the electronic catalog present on the website www.Agathoparfum.com as described in the relevant technical data sheets or in communications via e-mail, also following contacts with Caminus sales people, who can send to the Customer customized estimates, including sales prices, transport prices, payment methods, items in the delivery address and corresponding VAT.

The receipt of payment is confirmed by Caminus by e-mail sent to the e-mail address communicated by the Customer. This confirmation message will contain the order number, order date, billing information and recipient of the goods, details and VAT prices included of the ordered goods.

Only once payment has been received from the Customer, Caminus will start the phases related to the shipment of the goods.

Any notice of non-acceptance of the order due to unavailability of the product and / or longer delivery times than those indicated in the quote / product sheet, will be promptly communicated to the customer, by telephone or by e-mail. In such cases, the Customer may alternatively change the product, wait for availability in the new times communicated or cancel the order by requesting reimbursement for any sum already paid.

Any right of the Customer to compensation for damages is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or things, caused by the non-acceptance, even partial, of an order.

Any changes to orders already confirmed cannot be guaranteed and will be eventually authorized by Caminus based on the progress of the supply.

Purchases made on www.Agathoparfum.com are delivered, via national and international couriers, to the delivery address indicated in the order.

In some cases, to be checked individually, the customer is also entitled to collect the ordered material directly from the supplier’s warehouse, without transport costs.

During the ordering procedure, Caminus issues a suitable accompanying document for the material shipped (Transport Document) while the invoice will be sent to the email address previously communicated by the Customer. After issuing the invoice it will not be possible to make changes to it.

The shipping costs are calculated based on the weight of the goods to the place of destination. the quote is non-binding and does not entail the conclusion of the order, except after confirmation of the same and the transmission by Caminus of production orders to its suppliers.

The Customer can communicate every detail he deems necessary so that the courier can reach the place of delivery, reporting in the notes of the order or through an e-mail to info@Agathoparfum.com before shipping the goods from the manufacturers’ warehouses.

To facilitate the delivery Caminus includes free of charge for each order the telephone notice service by the courier. With this service the customer is contacted by telephone by the courier to establish the day and time of delivery. It is therefore advisable to enter a telephone number where you can always be reached.

Telephone notice must be understood as the possibility of agreeing delivery with the courier within 48 hours of notice Any storage costs, due to deliveries beyond the previously indicated deadlines (48 hours from the telephone notice) or due to repeated lack of response from the customer to contact attempts made by the courier to arrange delivery, will be totally charged to the customer.

Standard delivery takes place at street level.

National and international carriers carry out deliveries from Monday to Friday, in normal working hours regulated and indicated by them and cannot be syndicated by Caminus.

No responsibility can be charged to Caminus due to delivery delays attributable to the transporter in charge.

The products are packed with resistant materials and suitable to ensure optimal protection during transport.

In the case of receipt of goods that present obvious tampering and / or breakage of the packaging, the customer must accept the goods with “RESERVE OF CONTROL”, describing personally and in detail the damage on all copies of the courier’s delivery receipts.

Having ascertained the presence of damage caused by transport, the customer is obliged to report it to Caminus within 5 (five) days of receiving the goods by e-mail, complete with photographic documentation of the packages and damaged goods.

The Customer who for any reason has not followed the aforementioned indications of this contract can not later claim any shortages or damage caused by the carrier.

  1. Delivery time

Caminus undertakes to respect the times indicated in the estimate.

In each product and quote sheet the times for the delivery of the goods to their destination are reported, but they must not be considered binding by the Customer with respect to the conclusion of the contract stipulated with Caminus.

Delivery times can be checked at any time by the customer with Caminus operators by telephone or e-mail.

Any advances or delays in delivery times indicated in the product sheet, to a quote or supplied by e-mail or telephone that cannot be identified at the time of the order, but only during the preparation or production phases of the same, will be promptly communicated as soon as the same Caminus will know about it. In any case they cannot be considered by the customer for claims for damages or compensation as well as any contractual or extra-contractual liability for direct or indirect damages to people and / or things.

  1. Payment mode

The prices shown in the product sheet of the items that can be ordered online or budgeted and the relative transport costs are inclusive of VAT / VAT.

Following the purchase process, the customer can select the following payment methods:

  1. PayPal: PayPal is one of the most used payment systems in the world. By choosing this mode you will be able to pay through your personal PayPal account at the end of the transaction and by credit card.
  2. Bank transfer in advance: the methods of payment by bank transfer in advance require the acceptance and validity of the order, only after payment by the Customer and unequivocal receipt by Caminus of the bank transfer. The data to execute the transfer are communicated on the order confirmation page at the end of the online procedure or in the quote sent to the Customer. The purpose of the bank transfer must include the order number, the name and surname of the interested party of the order and a copy of the accountant must be sent by mail to info@Agathoparfum.com

 

  1. Right of withdrawal

In the presence of a customer-final consumer (private person) the right of withdrawal can be exercised according to the current legislation. In compliance with Legislative Decree 206/2005.

To exercise this right, the Customer, within 14 working days from the date of receipt of the goods, must send Caminus a notice by registered letter with acknowledgment of receipt in advance by e-mail to info@Agathoparfum.com stating that he wants to make use of the right of withdrawal and indicating the order number, the invoice number, item code and quantity, if the withdrawal is partial (only in case of purchase of more items) or total and the bank details to obtain the reimbursement transfer (code Iban of the invoice holder).

The goods must be returned intact in the original packaging properly sealed, complete in all its parts (including packaging, internal protections, external protection, wooden pallets and any documentation and accessory equipment: manuals, assembly equipment, etc.) to the address indicated by Caminus via courier appointed by the Customer as an alternative at: Centro Direzionale IS 7 / A, Naples

The shipping costs for returning the goods are charged to the Customer.

Caminus, after verifying the integrity of the goods, will proceed within 14 days from the return to the re-credit of the value of the product (s).

The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product.

The shipment for the return of the material, up to the attestation of receipt in our warehouse, is under the complete responsibility of the Customer.

In the event of damage to the goods during the return transport, Caminus will notify the customer of the incident (within 5 working days from receipt of the goods), to allow him to file a timely complaint against the courier chosen by him and obtain reimbursement of the value of the good (if insured); in this case the product will be made available to the customer for its return and at the same time the request for withdrawal and therefore reimbursement will be canceled.

Caminus is not responsible in any way for damage or theft / loss of goods returned by shipments not insured by the Customer.

The right of withdrawal is lost for lack of the essential condition of integrity of the property, in the cases in which Caminus ascertains:

  1. the non-diligent use of the good that has compromised the integrity or use of any consumables;
  2. lack of external and / or internal packaging;
  3. the absence of integral elements of the product (accessories, screws, etc.);
  4. damage to the product for reasons other than transportation.

They are excluded from the right of return:

– Custom made or customized products.

– Used or damaged items.

In the case of forfeiture of the right of withdrawal the goods will remain available to the Customer for his collection at his expense.

The right of withdrawal is NOT exercisable in the case of purchases of customized products according to the indications requested by the Customer and for which finishes of dyes or sample fabrics chosen or sent by the same have been made.

8.Guarantees

The products sold by Caminus are covered by warranty pursuant to Legislative Decree 206/05. In the case of purchase made by a subject defined as “final consumer” (private subject) the warranty is valid for 24 months and covers defects of conformity of the product. In all other cases the conventional guarantee is 12 months.

Inglese Impara la pronuncia Pursuant to Legislative Decree 206/05, the warranty applies to products that present a lack of conformity, provided that the product itself has been used correctly in respect of its intended use. In the event of a lack of conformity, Caminus will send the necessary spare parts to restore product conformity, free of charge for the customer. The labor costs necessary to restore the product will remain the responsibility of the end customer.

The Customer is required to check the goods and their operation within 5 days of delivery. Any defects already present at the delivery of the material must be communicated to Caminus within 5 days of receiving it by e-mail to info@Agathoparfum.com, indicating the article code, details and photographs of the defect found.

In the event that Caminus is unable to provide the Customer with a product under warranty (repair or replacement), the same may proceed with its consensual replacement with a product of similar or superior characteristics to the one disputed or to the repayment of the amount paid by taking account of the use of the good.

In cases of replacement under warranty, Caminus will collect the defective material for the effective verification of the defects claimed by the Customer. The withdrawal will be agreed with the Customer date and time slot.

The good under guarantee must be returned by the Customer in the original packaging properly sealed, complete in all its parts.

Caminus will take care of the organization of return transport and return of replacement / repaired goods under warranty, but the transport will still be charged to the Customer.

The customer is required to keep the original packaging and all additional documentation for the products purchased until the warranty terms of the product expire.

Caminus does not guarantee damage caused by incorrect use of the item.

If the unloading of the goods results in obvious damage to the packaging, it is necessary to:

EXPRESS A RESERVE: the package is accepted but before signing the document the Customer must affix the words “I accept with reserve right”, specifying the damage found as far as possible. It will be possible once the package is opened and the damage assessed, to be compensated in quick times for the damage suffered.

REJECT THE DAMAGED GOODS: if it is not possible to accept the package with reserve or if the damage is still visible without having to open the package.

In any case, the Customer is required to report the damage within 5 days of delivery. Otherwise Caminus will not be liable for any damage. The Customer is required to keep a copy of these “general conditions of sale and purchase” in paper or electronic form valid at the time of stipulation of the distance contract (customer order receipt).
